Terms of Sale & Custom Order Policies

These Terms of Sale apply to purchases of custom-fabricated products from AVA Edge Inc. (“AVA Edge”).

1. Custom Products

AVA Edge products are custom-manufactured based on the customer’s requested specifications and, in most cases, using flooring or other materials supplied by the customer.

Because these Products are custom-made, customers are responsible for reviewing and confirming all product specifications before production begins.

2. Measurements & Specifications

The customer is responsible for providing accurate measurements, dimensions, product selections, quantities, and other information required to manufacture the order.

AVA Edge manufactures Products according to the measurements and specifications provided by the customer, dealer, contractor, or representative.

AVA Edge is not responsible for incorrect measurements, incorrect specifications, incorrect product selection, or installation conditions that differ from the information provided when the order was placed.

3. Orders, Cancellations, Returns & Refunds

Because AVA Edge Products are custom-made:

Orders may not be canceled once production has started.
Custom Products cannot be returned due to changes in preference, incorrect measurements supplied by the customer, or other customer-related reasons.
Custom Products are not eligible for refunds except where expressly provided under the AVA Edge Limited Warranty.
Approval of an order, whether verbal, written, signed, or confirmed by delivery or drop-off of materials to AVA Edge, constitutes the customer’s acceptance of all product specifications, measurements, quantities, and materials provided for the order. Once approved, the order will be considered final and will proceed to production.

4. Buyer-Supplied Flooring & Materials

When customers provide flooring or other materials for fabrication, they are responsible for supplying sufficient material in suitable condition for production.

AVA Edge will manufacture the Product using the material provided according to the approved order specifications.

AVA Edge is not responsible for variations, defects, damage, color differences, manufacturing inconsistencies, or other characteristics present in the customer’s flooring or materials.

5. Shipping to AVA Edge

For orders requiring customers to send flooring or other materials to AVA Edge:

The customer is responsible for all shipping costs to AVA Edge.
Materials should be properly packaged to prevent damage during shipment.
Customers are encouraged to use a trackable shipping service and retain shipping documentation.
AVA Edge is not responsible for damage or loss occurring during shipment to AVA Edge when the shipment is arranged by the customer.
AVA Edge is not responsible for delays, damage, or additional costs resulting from improperly packaged, mislabeled, or incomplete shipments.

6. Return Shipping of Completed Products

The customer is responsible for return shipping costs for completed custom Products.

AVA Edge will package completed Products for shipment using reasonable care. Once the shipment has been accepted by the carrier, AVA Edge is not responsible for carrier-related delays, loss, or damage.

For freight shipments, the customer is responsible for arranging and coordinating pickup with the freight carrier.

7. Product Pickup & Shipping

Customers must pick up completed products or arrange shipment within 14 calendar days of completion notification. For shipped orders, shipping arrangements and pickup details must be provided to AVA Edge within 3 business days of notification. Products not picked up or shipped within 14 days may be subject to storage fees or forfeiture of the product.

8. Production Time

Custom Products may require additional production time due to the nature of custom fabrication.

Estimated production times are provided at the time of quotation or order and may vary depending on Product, quantity, and current production schedule.

Production time begins after all required materials, measurements, specifications, approvals, and payments have been received by AVA Edge.

9. Installation

AVA Edge Products are intended to be installed according to applicable installation requirements and AVA Edge instructions.

The customer, contractor, or installer is responsible for verifying job-site conditions and ensuring that the Product selected is appropriate for the intended application.

AVA Edge is not responsible for installation labor, installation errors, improper installation, or damage resulting from installation.

10. Templates

Where an AVA Edge installation template is required, customers should use the appropriate template to ensure proper placement and sizing during installation.

Failure to use a required template may result in an improper fit and will affect warranty coverage.

11. Product Selection

The customer is responsible for selecting the correct Product, size, dimensions, and application for their project.

Customers should verify duct dimensions, stair dimensions, flooring specifications, and other applicable measurements before ordering.

AVA Edge is not responsible for Products ordered in an incorrect size or for an application that differs from the information provided at the time of purchase.

12. Acceptance of Terms

By placing an order with AVA Edge, the customer acknowledges that they have reviewed and accepted these Terms of Sale.

Limited Warranty

This Limited Warranty is issued by AVA Edge Inc. (“AVA Edge”) and applies to AVA Edge products, including custom-fabricated stair noses, full stair treads, floor vents, and related products (“Products”).

1. Warranty Coverage

AVA Edge warrants that its Products will be free from defects in materials and workmanship under normal use and service for a period of one (1) year from the date of the original retail purchase by the end user (“Warranty Period”).

This Warranty applies only to the original purchaser and is non-transferable. Proof of purchase is required for all warranty claims.

2. Warranty Claim

To make a warranty claim, the original purchaser must contact the dealer, distributor, or reseller from whom the Product was purchased. If the dealer is unavailable, the purchaser may contact AVA Edge directly at AvaEdgeStair@gmail.com.

The purchaser must provide:

Proof of purchase
A written description of the issue
Clear photographs and/or video showing the claimed defect
Any additional information reasonably requested by AVA Edge

AVA Edge reserves the right to inspect or evaluate the Product before determining whether the claim is covered under this Warranty.

3. Warranty Remedy

If AVA Edge determines that a Product has a defect in workmanship covered by this Warranty, AVA Edge may, at its discretion:

Repair the Product;
Replace the Product with an equivalent Product; or
Refund the original purchase price of the defective Product.

4. Warranty Exclusions

This Warranty does not cover damage, defects, or performance issues resulting from:

Improper installation
Improper use, maintenance, handling, storage, or care
Repairs, alterations, or modifications
Normal wear and tear
Scratches, stains, fading, discoloration, or other cosmetic changes resulting from normal use
Accidents, misuse, abuse, negligence, or abnormal use
Excessive weight, impact, or failure to provide required support
Flooding, excessive moisture, excessive humidity, or other environmental conditions
Use of incompatible or third-party components
Incorrect Product selection, sizing, or application
HVAC incompatibility or incorrect duct sizing
Damage or defects originating from customer-supplied flooring or other materials
Failure to follow AVA Edge installation instructions
Failure to use the AVA Edge template during install (Vents only)
Damage occurring during installation or after installation that is not caused by a defect in product or workmanship

5. Customer-Supplied Materials

For Products manufactured using flooring or other materials supplied by the customer, this Warranty covers AVA Edge's workmanship and fabrication of the Product only.

AVA Edge does not warrant defects, damage, inconsistencies, color variation, wear, or other characteristics originating from customer-supplied materials.

6. Limitation of Liability

To the fullest extent permitted by law, AVA Edge's liability under this Warranty is limited to the repair, replacement, or refund of the defective Product.

AVA Edge shall not be responsible for indirect, incidental, special, or consequential damages arising from the use, installation, or inability to use a Product, to the fullest extent permitted by law.

7. Disclaimer of Other Warranties

No AVA Edge representative, dealer, distributor, reseller, contractor, or other party is authorized to modify, extend, or otherwise alter this Warranty on behalf of AVA Edge.
